Attorney General's Collaborative Dispute Resolution Model Rules
The Administrative Procedures Act (APA) requires state agencies to adopt rules of procedure for use in rulemaking, contested cases and other administrative proceedings. The APA also directs the Attorney General to prepare Model Rules of procedure that state agencies may adopt.
This web site describes only the "collaborative dispute resolution" - related Model Rules. ORS 183.502(3) authorizes the Attorney General, in consultation with the Oregon Dispute Resolution commission and the Oregon Department of Administrative Services, to develop for agencies model rules for the implementation of alternative means of dispute resolution. These collaborative dispute resolution Model Rules are intended to be used in conjunction with the Attorney General's Model Rules related to rulemaking, contested cases or other administrative proceedings. The following table summarizes the collaborative dispute resolution Model Rules prepared for state agencies by the Attorney General. Like all of the Model Rules, an agency may adopt all or part of these rules by reference without complying with the rulemaking procedures of ORS 183.325 to 183.410.
The Attorney General's collaborative dispute resolution Model Rules are provided here for convenience. The official, record copy of the rules is the printed copy filed with the Secretary of State and published in the Oregon Bulletin. These rules represent only part of the Model Rules prepared by the Attorney General and only some of the ADR and collaborative DR provisions found in the Model Rules. The complete set of Model Rules, including commentary, sample notices and forms can be found in the Attorney General's Administrative Law Manual. The manual is updated and published every two years following the adjournment of the regular legislative session.
