Attorney General Sues Albany Spa Man For Taking Money From Consumers And Not Providing Spas Or Repairs

Attorney General Hardy Myers today sued an Albany man, who has a long history with the Oregon Department of Justice for allegedly taking money for spas, hot tubs and repairs and not providing the goods or services. Named in the lawsuit filed today in Linn County Circuit Court is Danny Waters, who does business in Albany as Blue Water Spas, Castleberry's Blue Water Spa and Spa One.

"Due to the high number of victims and Water's four-year history with Justice, we felt it necessary to take action," Myers said. "Pressure by our office to assist consumers sometimes helped but Waters continued to ignore our formal warnings and refused to sign a proposed settlement agreement."

Justice investigators interviewed 15 complainants, who paid Waters in advance for spas, hot tubs, related equipment such as covers and chemicals and for needed repairs. In most cases, consumers from Linn, Marion and Columbia counties never received the spas, hot tubs, equipment or refunds. Repairs were either never started or never completed. Victims' losses range from $50 to $4,000.

The lawsuit asks for a permanent injunction against the defendant from operating a spa repair or sales business in Oregon and from conducting any form of Oregon business, in which he receives money or property from any consumer prior to completion of work or delivery of a product.

Justice also seeks full restitution for the 15 victims, civil penalties of $25,000 per violation of the Unlawful Trade Practices Act and reasonable attorney fees.
