Attorney General Files 15 Court Actions Against Violations of 'No Call' List Law

Attorney General Hardy Myers today filed 15 court actions in Marion County Circuit Court against violators of Oregon's "No Call" List telemarketing law as the Department of Justice continues its tough enforcement of the year-old statute.

"This third sweep of actions reminds telemarketers calling into Oregon that we have strict laws protecting Oregonians' privacy," Myers said. "Oregon consumers like the new law that limits "cold calls" into their homes and continue to support our efforts to enforce it."

Named in Assurances of Voluntary Compliance that admit no law violations are:

  • AA Rite-Way Roofing, Inc., Portland; gutter & roofing services
  • American Family Insurance, Madison, Wisconsin; insurance
  • Century One Builders, Phoenix, Arizona; home construction
  • Crime Free Security Systems, Inc., Portland; security systems
  • Farmers Insurance, Tigard; property/casualty insurance
  • First USA Bank, Wilmington, Delaware; banking, credit cards
  • Huth, Patricia (dba Wild West Tours, Bob Less Tours, Trade Wind Tours), Seattle, Washington; markets vacation tours
  • Krane Products of South Florida, Inc., Boca Raton, Florida; sells a variety of consumer products
  • Northwest First Choice, Inc., Vancouver, Washington; window and siding sales/installations
  • Sprint Communications Company LP, Overland Park, Kansas; long distance telecommunications
  • Statewide, Inc., Vancouver, Washington; home construction
  • Qualfund Lending, Inc., Redmond, Washington; credit lending
  • Stardust Credit Corporation (dba Castleview Home Loans), Fullerton, California; mortgage and credit lending
  • Western American Glass Enterprises (dba The Glass Shop), Milwaukie; auto glass sales and installation
  • Western Builders & Design Corporation, Portland; construction

Under the terms of the assurances, all 15 businesses agree to comply with Oregon's telemarketing laws and make changes in the way they do business in the state. Those named will pay a total of $63,225 to the Department of Justice consumer protection and education fund.

Two businesses, Farmers Insurance and Western American Glass Enterprises, signed second agreements with the Department of Justice.

Patricia Huth, also known as Patricia Coble, who markets vacation tour packages as Wild West Tours, Bob Less Tours, Trade Wind Tours and Pacific Activity Center has agreed to permanently cease telemarketing in Oregon and will not conduct vacation tour marketing in the state.

Department of Justice investigators found that Ms. Huth's telemarketing business in addition to violating the "No Call" law violated another section of the Unlawful Trade Practices Act by telling consumers that they had won a prize or raffle when in fact, they had not. Approximately 26 consumers complained of the misleading telemarketing promotion used to sell vacation tour packages.

"No Call" List violations ranged from companies telemarketing into the state without subscribing to the "No Call" list to companies that purchased the lists but did not take the necessary steps to comply with the law.

Telephone subscribers wanting to register their residential numbers on the List may call the list administrator, Oregon No Call, at 1-877-700-6622 and ask to have a registration form mailed to their home. Consumers also may visit the Oregon "No Call" List web site at www.ornocall.com.

Consumers pay $6.50 the first year and $3 a year for each additional year they remain on the list. The list is published quarterly but consumers can register at anytime. Depending on which part of the quarter a person registers, it could take up to 90 days to appear on the list. The fees are non-fundable and consumers will be notified when it is time to renew the registration. Online registration will be available within the next few months.
