Oregon Attorney General Hardy Myers today announced the entry of guilty pleas by Ricky Lynn Johnson, president of NuStart Concepts, Inc., to twenty felonies stemming from his criminal activities in the solicitation and acceptance of investments in NuStart. NuStart Concepts, Inc., which also does business as ReStart and KidStart, is located in Lake Oswego, Oregon. The company claims to market nutritional snack bars.
Johnson pled to four counts of aggravated theft in the first degree, two counts of theft in the first degree, four counts of selling an unregistered security, four counts of sale of securities by an unlicensed person, and six counts of securities fraud.
Sentencing is set for October 10, 2005 at the Clackamas County Courthouse in Oregon City before the Honorable Thomas J. Rastetter. In addition to seeking a substantial period of incarceration in prison, the Department of Justice will seek an order requiring Johnson to pay full restitution to all investors in NuStart Concepts, Inc. The Department of Justice also is working to have NuStart's corporate charter dissolved.
The Department of Justice and Oregon Department of Consumer and Business Services' Division of Finance and Corporate Securities (DFCS) are working to identify and locate all investors in NuStart Concepts, Inc. Individuals who invested in NuStart Concepts, Inc, ReStart or KidStart should contact the Department of Justice at (503) 378-6347.
Justice and DFCS officials alleged that Johnson and NuStart bilked over 300 investors for nearly $3 million between 1993 and 2005.
The case was initiated by DFCS in August 2001. Department of Justice officials joined the investigation in June 2003. Johnson is currently being held in the Clackamas County Jail.
