Oregon Attorney General Hardy Myers today announced the filing of an Assurance of Voluntary Compliance with westcoastwagers.net over its unauthorized use of Oregon Food Bank's name in text message solicitations. Domain name owner Iosif Y. Skorohodov has paid the Department of Justice $5,000 in restitution and investigative costs and agreed to abide by Oregon laws governing charitable solicitations in the future.
"Oregon charities must be protected from individuals seeking to use their good names for personal gain," Myers said. "My office will actively pursue any unscrupulous commercial activity threatening our charitable organizations."
In March, Oregon Food Bank contacted the Department's Charitable Activities Section about unsolicited text messages from westcoastwagers.net. These messages claimed a $5 contribution would be made to Oregon Food Bank for each new player to register with westcoastwagers.net. Oregon Food Bank had not authorized the use of its name and does not engage in telephonic solicitation.
Oregon's charitable solicitation laws contain specific provisions for commercial entities that wish to raise funds on behalf of named charities. The law prohibits use of a charity's name in commercial solicitation without written permission, requires disclosure of the portion of any sale that will benefit the charity, and mandates record retention requirements.
