LINCOLN COUNTY PROSECUTOR PLEADS GUILTY TO OFFICIAL MISCONDUCT

December 14, 2010

Rand E. Overton, a Lincoln County deputy district attorney, admitted using his position to attempt to obtain sexual favors

Attorney General John Kroger today announced the guilty plea and sentencing of a Lincoln County prosecutor for attempting to use his position to obtain sexual favors.

"Prosecutors wield great power, and any abuse of that power cannot be tolerated," said Attorney General Kroger. "Government officials need to be held to the highest possible standards."

Rand Eugene Overton (DOB: 9/19/51), a Lincoln County deputy district attorney, pleaded guilty to 2 counts of Official Misconduct in the First Degree. He was sentenced to 30 days in jail, 2 years of probation and is prohibited from working as a government lawyer.

Overton was initially charged in May based on a single victim. Once the charges became public, two additional victims came forward.

As part of a plea agreement, Overton admitted using his position as a deputy district attorney to try and obtain sexual favors. Two victims were women who owed or were receiving child support. Another victim was a victim of domestic violence.

Senior Assistant Attorney General Dan Wendel prosecuted the case for the Oregon Department of Justice.

Attorney General John Kroger leads the Oregon Department of Justice. The Department's mission is to fight crime and fraud, protect the environment, improve child welfare, promote a positive business climate, and defend the rights of all Oregonians.
