Update

Appeal of preliminary injunction order is pending in the First Circuit. On 3/26/25, the First Circuit denied federal defendants’ motion for a stay pending appeal. The parties have briefed the case in the First Circuit, which held oral argument on 11/18/25.

After oral argument, the First Circuit mostly affirmed the preliminary injunction.

On 8/19/26, the federal defendants informed the district court that they were no longer contesting the merits of the plaintiff states’ Administrative Procedure Act claims, and that they would soon file a proposed order of final judgment.

On 8/20/26, the district court entered a briefing schedule for the proposed order of final judgment, with briefing set to be complete by 11/13/26.
