Update

A hearing was held and a Temporary Restraining Order (TRO) was issued.

On 2/6/25, the district court issued a preliminary injunction order, and the federal defendants appealed.

On 3/13/25, federal defendants applied for a stay from the injunction from the Supreme Court. After hearing oral argument, the Court issued an order granting a partial stay on 6/27/25.

On remand, the Ninth Circuit affirmed the district court’s preliminary injunction order, ruling that the states have standing; that the birthright citizenship executive order is unlawful; and that a universal injunction is appropriate.

On 9/26/25, the government filed a petition for writ of certiorari, asking the Supreme Court to take the case. While that petition was pending, the Supreme Court issued an opinion on 6/30/26 in a separate case (Trump v. Barbara), upholding the right of birthright citizenship. That same day, the Supreme Court denied the federal defendants’ petition for writ of certiorari in the states’ case.
